Terms of Service

Welcome to Kidim. By creating an account or using the Kidim platform at kidim.bywillo.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you ("you" or "Parent Account Holder") and Kidim ("we," "us," or "our").

1. Eligibility and Parental Consent

  • You must be at least 18 years old to create an account and agree to these Terms.
  • The Service is designed for children; children do not create their own accounts. As a parent or legal guardian, you are responsible for supervising your child's use of the Service and for all activity under your account.
  • By creating a child profile, you represent that you are the parent or legal guardian of that child and that you consent to our collection and use of your child's information as described in our Privacy Policy.

2. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must provide accurate, current, and complete information when registering.
  • Notify us immediately at support@kidim.ai if you believe your account has been compromised.
  • One account per household. You may not create multiple accounts to circumvent plan limits.

3. Subscription Plans and Billing

3.1 Plans

Kidim offers the following plans:

  • Free: No charge. Subject to usage limits described at /pricing.
  • Family: Billed monthly or yearly as listed on the Pricing page.
  • Family Pro: Billed monthly or yearly as listed on the Pricing page.

Plan features and prices are subject to change. We will provide at least 30 days' notice before changing prices for existing subscribers.

3.2 Billing and Renewals

  • Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
  • Payment is processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Switching from monthly to yearly billing takes effect at your next renewal.

3.3 Cancellations and Refunds

  • You may cancel your subscription at any time from your account settings. Access continues until the end of the current billing period; we do not prorate partial periods.
  • We do not offer refunds for partial subscription periods except where required by law.
  • If you believe you were charged in error, contact us within 14 days at billing@kidim.ai.

4. Acceptable Use

You agree not to use the Service to:

  • Attempt to circumvent, disable, or interfere with safety filters or content moderation systems.
  • Input, elicit, or distribute content that is harmful, abusive, sexually explicit, violent, or otherwise inappropriate for children.
  • Scrape, reverse-engineer, or use automated tools to access the Service outside of normal usage.
  • Impersonate another person or organization.
  • Violate any applicable law or regulation, including COPPA.
  • Resell, sublicense, or commercialize access to the Service.

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

5. AI-Generated Content

  • Kidim's responses are generated by AI and are provided for educational and entertainment purposes. They are not a substitute for professional tutoring, medical, legal, or other expert advice.
  • AI systems can make mistakes. We encourage parents to review conversations using the parent dashboard.
  • You retain ownership of the original content you input. You grant us a limited license to process that content solely to provide the Service.
  • AI-generated responses are owned by Kidim and licensed to you for personal, non-commercial use within the Service.

6. Privacy

Our Privacy Policy describes how we collect and use personal information and is incorporated into these Terms by reference.

7. Intellectual Property

All content, software, trademarks, and materials comprising the Kidim Service are the property of Kidim or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Kidim, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States. Any dispute shall be resolved by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 14 days in advance by email or prominent in-app notice.

13. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time from your account settings. Sections 5, 7, 8, 9, 10, and 11 survive termination.
